FCC Approves Fries, VA Tower Over Historical Preservation Groups Objections
The FCC has rejected petitions to deny a wireless authorization filed by an organization calling itself Fries Friends For Intelligent Tower Siting (FFFITS) and challenging Commission acceptance of a constructed tower near Fries, Virginia, owned by US Cellular of Virginia RSA #2, Inc., a subsidiary of United States Cellular Corporation. The Commission also rejects the organizations Petition for Reconsideration of a letter, issued by the Spectrum and Competition Policy Division of the Wireless Telecommunications Bureau finding that USCC did not construct the tower with intent to avoid the required historic preservation review process, and denies review of an Order adopting a Consent Decree between USCC and the Enforcement Bureau. Verizon Wireless Agrees to Pay $468,600 for Violating Emergency Planning Law

New Jersey FM Fined for Exceeding Antenna Height, RF Limits
The Regional Director, Northeast Region, of the FCCs Enforcement Bureau June 3 issued a forfeiture of $25,000 against an Asbury Park, N.J FM licensee that willfully and repeatedly exceeded the Commissions RF radiation and maximum permissible exposure limits while operating with an excessively tall antenna antenna sited at an unauthorized location. Industry Coalition Opposes Petition for Expedited Environmental Rulemaking
On May 29, an industry group calling itself The Infrastructure Coalition--comprising CTIA-The Wireless Association, the National Association of Tower Erectors, PCIA-The Wireless Infrastructure Association, and the National Association of Broadcasters--filed comments opposing the petition for expedited rulemaking filed April 14 by the American Bird Conservancy, the Defenders of Wildlife, and the National Audubon Society. The comments were filed in the FCCs rulemaking proceeding on Environmental Compliance Procedures for Processing Antenna Structure Registration Applications, WT Dockets 08-61 and 03-187, which was instituted in response to the decision of the U.S. Court of Appeals for the District of Columbia Circuit in American Bird Conservancy, Inc. v.
